Who is an Ontario class member?
“Ontario Class”
means all persons resident in the Province of Ontario as of February 18, 1993 or who received their implants in the Province of Ontario, who have had silicone gel Breast Implants placed in their bodies, whose implants were manufactured, developed, designed, fabricated, sold, distributed or otherwise placed into the stream of commerce by Dow Corning and who did not timely exercise their rights to opt out of the Ontario Class or, if they did exercise such rights, who also exercised their rights to opt back into the Ontario Class pursuant to the procedures set forth in the Registration Form, Exhibit F-1 to this Agreement.

Note: Supplemental Family Claims are eligible only if the breast implant recipient received a Dow Corning Product and if a US Proof of Claim Number was also filed for the family member. Family members to “Raw material” breast implant recipients are not eligible.

Registration deadline

  November 16, 2004 - Deadline for registering and filing an Expedited and Current Primary claim.
  June 16, 2005 - Deadline for registering and filing a Raw Material, Supplemental/Family.
  June 16, 2005 - Deadline for registering an Ongoing claim. The Claims Administrator is no longer accepting any new submissions.
  June 16, 2009 – First Ongoing Primary Claim Allocation Period - Deadline for submitting documentation for ‘ongoing’ claim.
  April 16, 2011 - Final Claim deadline for submitting documentation for an Ongoing claim and Compensation for More Serious Medical Conditions Developing After an Award of Compensation for an Approved Current Primary Claimant.

Compensation

*All approved Expedited claims were compensated in 2005. All Raw Materials and Supplemental/Family Member claims were compensated in 2007. All Current Primary claims were compensated with the following percentage of compensation:

  • Year 2005 – 45%
  • Year 2006 – 45%
  • Year 2007 – 10%
